Welcome to the All Borough Party Rentals (“Party Rental,” “Company,” “We,” “Us,” or “Our”) website. The following Terms are a contract between You and All Borough Party Rentals, including any of its affiliates, successors and subsidiaries in regard to the us and access to the components of our website, and any services the website provides. Any references to All Borough Party Rentals includes all affiliates and subsidiaries we work with.

1) Terms of Use:

a) Acceptance. 

By accessing and using Our Site, You accept and agree to be legally bound by these Terms and all prospective amendments to these Terms, including Our Privacy Policy. This agreement is made by You just as if it had been made in writing. If You do not agree to these Terms, do not use this Site or any of our online features, products, or services.

b) Amendment. 

We may amend these Terms from time to time in Our sole discretion. All amendments to these Terms will be effective immediately upon posting. Your continued access to Our Site constitutes an agreement to be bound to the Terms then effective and as amended. You also agree to accept notice of posting of any amendments or new terms through Us posting such amendments or new terms on the Site. Please review the Terms periodically so you are aware of any amendments.

c) Additional Terms.

 Although you are always bound by the Terms, in using additional features, products, or services you may be bound by and subject to additional terms, including but not limited to Frequently Asked Questions (“FAQs”), guidelines, and rules applicable to certain features, products, or services. These additional terms may be posted and modified periodically. Any and all additional terms will not change or replace these Terms regarding use of the Site, unless expressly stated. Any and all additional terms are incorporated within these Terms by reference. To the extent You participate in Our contest, sweepstakes, or marketing activity (“Promotion”), these Terms apply with any additional Promotion rules, regulations, contracts, terms or agreements.

d) Capacity. 

This is a general audience Site and service for adults. We will assume (and by using this Site You warrant that) You have legal capacity to enter into the agreement set out in these Terms, including but not limited to, that You are of sufficient age and mental capacity, and are otherwise entitled to be legally bound in contract.

2) Privacy

Your privacy is important to us. By accessing our website, you agree to the collection and storage of your personal information as outlined by our Privacy Policy. 

3) Ownership

All website material including, but not limited to, logos, images, media, copy, text, product names, descriptions (“Intellectual Property”) are protected by copyright, and trademark laws of the United States. 

4) Monitoring

The activity of the website may be monitored by All Borough Party Rentals, and any information related to users and their respective activities may be monitored, copied, distributed at any time.

5) INSURANCE

If you need a certificate of insurance please email your buildings or municipality’s requirements to us at least 3 business days before the event.

6) ADDITIONAL CHARGES

May apply if:

  • The site is not ready or accessible when the crew arrives
  • The tent and rented equipment is not ready for pre-arrange pick up
  • Delivery and/or pickup is from a location other than the ground floor level (upstairs or downstairs)
  • All chairs and tables are not stacked and bagged as delivered for pick up 
  • Food service items are not food-free
  • Customer requires deliveries and pickups before or after normal business hours
  • Site requires custom tent installations ( i.e. on decks, patios, rooftop or balcony )

7) CLEANUP/PREPARATION FOR PICK UP 

All trash, decorations, floral arrangements of any kind should be removed from tent before scheduled pickup time.

All chairs and tables should be stacked & bagged the same when delivered.

All dishes, glassware and cooking equipment should be returned to proper rack or container and assembled at a single location for pick up. Dishes, glasses, flatware and food service equipment must be food free. 

All linens should also be food and particle-free and be shaken out,  and put into the bag/boxes provided. Linens that are returned with burns, holes, tears or are permanently stained will be billed at replacement cost.

8) DELIVERY/PICKUP SERVICE

Delivery service is available on all orders regardless of size. All fees are based on tailgate delivery and charged by geographical location. Additional delivery charges will occur for second floor or higher delivery locations, basement delivery locations using stairs, excessive distance for loading/unloading trucks, specific delivery and pickup times and after-hours delivery and pickup. Delivery fees quoted may change after site inspection.

RENTAL CONTRACT & TERMS AND CONDITIONS
Information:

-Damaged or missing dishes, glassware and silverware or any type of food service equipment is for items above 3 per item. If damaged please place back in the rack it was delivered in, or if the item did not come in a rack, place to the side. For any items that are damage or missing above 3 per item (not total order) replacement cost will be charged.

-Chairs need to be stacked neatly back on dollies before pick up. There is a sticker on the back of most chairs. The sticker must face upwards – Please stack them neatly and correctly. If chairs are not stacked, or stacked in a sloppy manner there will be a charge of $0.25/chair. This method greatly helps us with efficiency and keeping labor costs down, which in turn allows us to provide the best price we can to each customer. Non padded chairs stack 50 high and padded chairs stack 25 high.
-If your venue requires pick up the same night as your event – please let us know. There is an additional charge for any late night pick ups. The charge will vary on the size of the rental order and the time of required pick up.

-If delivery and set-up is up more than 5 steps, please let us know. If we show up and there are a lot of steps, we will amend the bill. If we are told before hand we will let you know the price for the extra time involved.

Renting a tent:
-Please have marked the location of where the tent is going before delivery, you can use sticks in the ground, paint, furniture or any thing else – This helps us greatly with efficiency.
-If renting sidewalls they are not allowed to be removed. We will show you how to open them up safely so they do not get damaged
-Tents, Sides and Heaters are the only items that there is no refund or partial refund if cancelled the week of.
-No staples, tacks or pins can be used to attach your own things to any equipment. Any damage will result in a charge to fix or replace equipment.
-If delivery location is not easily accessible, is on a hazardous road, or in a location where large trucks do not usually go there can be an audit to the final price.
-All obstacles in the way of setting up the rented equipment need to be removed from the area, that includes tree branches that could be a hazard to the tent. We are not authorized to touch or move anything that could be in the way. If the clearing of the area takes more than 10 minutes there will be a $10.00 charge for every 10 minutes after the first 10.
-Drilling holes in pavement is a charge of $5.00 per hole; please let us know ahead of time if this will be necessary. If upon delivery it is discovered that we need to drill holes there will be a charge of $5.00/hole.
-If holes need to be put in pavement we do not fill them in after removal unless otherwise arranged.
-Table linens are inspected by Lessor prior to delivery to Lessee and upon return. If there is obvious damage such as mildew, excessive stains, burns or tears to linen, Lessee will be charged the cost of the linen. Return all linens dry and free of waste.

Renting a Patio Heater:

-Each heater must have a minimum 4 ft clearance from any object or structure on all sides and from the top. Each heater is tested for proper functionality prior to delivery for every order. Winds and wind gusts may reduce the heating diameter of this outdoor heater and may occasionally cause the heater to shut off. If the heater shuts off due to a wind gust, the Renter will have to turn it back on to continue using the heater. However, this heater should not be used when there are winds or wind gusts of 10 mph or greater. There are NO REFUNDS for any unused heaters or propane.  Please do not switch out our propane tanks for your own. Our propane tanks are specially serviced for safe usage by our customers and are marked property of All Borough Party Rental of NYC Corp. heaters or propane.

All rental:

– Lessee agrees to pay for any damage to rented equipment regardless of cause, except reasonable wear and tear, while equipment is out of possession of Lessor. Lessee also agrees to pay a reasonable cleaning charge for all equipment returned dirty, in Lessor’s sole, reasonable judgment. Accrued rental charges cannot be applied against the purchase or cost of repair of damaged goods. Rental Equipment damaged beyond repair will be paid for by Lessee at it Replacement Cost when rented. The cost of repairs will be borne by the Lessee, whether performed by Lessor or at the Lessor’s option by others.

-Equipment, other than tents, left out in rain/weather is excessively worn. This is not normal wear and tear. A prorated rate of 1/8th of the replacement cost will be charged to the Lessee for equipment left out in the weather.

-The Lessee agrees to pay for equipment (at its replacement cost when rented) for all types of theft or disappearance.

Please review the estimate and return signed with selected payment method.

-A credit card is required to secure your order. Please allow 48 hours for cancellation or rescheduling the date of the event. Failure to timely cancel will result in a full charge for the scheduled service.
We accept the following forms of payment: Cash, Credit Cards ( incure 3% convenience fee ), Business/Certified Check.

-Please return completed acceptance form ( which is send with the estimate) regardless of the payment method and security reason.
